Terms of Service

ChadGPT is a web based AI coaching chat operated by AyyLabs Ltd.

You can reach us at hello@chadgpt.plus or through chadgpt.plus.

These terms form a contract between you and us when you create an account or use the service. If you do not accept them, do not use ChadGPT.

Consumer means you are using ChadGPT wholly or mainly for personal use. Business user means you are using it for your trade, business, craft or profession. Some sections below are marked as applying only to business users. If you are a consumer, those marked clauses do not apply to you.

• You must be at least 16 years old to create an account.
• Give accurate details and keep your email address up to date.
• Keep your password private. You are responsible for activity under your account.
• One account per person. Do not share your login.
• Tell us at hello@chadgpt.plus if you think someone else has access to your account.

You must not:

• Use ChadGPT for anything unlawful, or to create or share unlawful content.
• Harass, threaten, defame or abuse anyone, or encourage others to do so.
• Infringe anyone's intellectual property, privacy or other rights.
• Scrape, crawl, data mine or bulk extract anything from the service.
• Reverse engineer, decompile or try to extract the source code, prompts or models behind the service, except where the law says you may.
• Circumvent the daily reply limit, rate limits, authentication or any other security or usage control, including by creating multiple accounts.
• Use bots, scripts or other automated means to access the service.
• Resell, sublicense or provide access to ChadGPT as part of your own product.

If you see something that breaks these rules, email us at hello@chadgpt.plus and we will look into it.

You keep ownership of everything you type into ChadGPT. You grant us a non exclusive, worldwide, royalty free licence to host, store, transmit, process and display your messages, only so far as needed to run the service for you and to keep it safe and lawful. That licence ends when the content is deleted, apart from copies we must keep by law.

What you type is sent to an AI provider so a reply can be generated. Your message and the recent turns of the conversation go to the Lovable AI Gateway, which passes them to Google's Gemini model. Do not enter passwords, payment details, health records or anything else you would not want processed by a third party. The Privacy Policy explains this in full.

We own the ChadGPT app, its code, design, branding, name and logo. Nothing in these terms transfers any of that to you. You get a personal, revocable, non transferable right to use the service under these terms.

Every reply in ChadGPT is generated by an AI model. It is written in a deliberately blunt coaching style. It can be wrong, out of date, incomplete or simply made up.

Output is not professional advice. It is not medical, mental health, legal, financial, nutritional or fitness advice. Do not rely on it as such, and check anything important with a qualified professional before you act on it. You are responsible for what you do with the output.

If you are in crisis or at risk of harm, contact your local emergency services or a professional support service. ChadGPT is not a crisis service.

ChadGPT is currently free to use. Each account gets a limited number of AI replies per day (ten at the time of writing), which resets at midnight UTC. We may change these limits, and we will tell you in the app if we do.

We may add, change or withdraw features, and the service may be unavailable for maintenance, upgrades or reasons outside our control. We will give notice of planned downtime where we reasonably can.

There are no paid plans today and we do not take payments. If we introduce paid plans, we will publish the plans, prices, billing cycle, auto renewal and cancellation terms, our refund position and your statutory 14 day cancellation right for digital services before anyone is charged, and nobody will be charged without agreeing to them first.

So far as the law allows, ChadGPT is provided "as is" and "as available". We do not warrant that it will be uninterrupted, timely, secure or error free, that defects will be corrected, or that output will be accurate, complete or fit for any particular purpose. To the extent they can lawfully be disclaimed, we exclude implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non infringement.

Your statutory rights as a consumer are not affected. We will supply the service with reasonable care and skill, as required by the Consumer Rights Act 2015. Nothing in this section removes or limits any right you have under that Act or any other consumer protection law.

Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of the terms implied by sections 9 to 11 of the Consumer Rights Act 2015 (satisfactory quality, fitness for purpose and description); or any other liability that cannot lawfully be excluded or limited.

Subject to that, and so far as the law allows, we are not liable for indirect, incidental, special, consequential or punitive losses, including lost profits, lost revenue, lost or corrupted data, lost goodwill or business interruption.

If you are a consumer: our total liability to you for all claims connected with the service is capped at the greater of the amount you paid us in the 12 months before the claim, or GBP 100. We remain responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. Loss is foreseeable if it is obvious that it will happen, or if at the time of the contract both we and you knew it might happen.

If any part of this section is found to be unenforceable, the rest of it continues to apply.

If you are a consumer: you agree to reimburse us for losses we actually suffer as a direct result of your own unlawful conduct, content you submit that is unlawful or infringes someone else's rights, or your breach of the Acceptable use section, and only to the extent those losses were caused by you. Nothing here affects your statutory rights, and we will not ask you to cover losses we could reasonably have avoided.

We may suspend or terminate your account only on one of these grounds:

• You have broken these terms, including the Acceptable use section.
• You are using the service unlawfully, or to harm someone.
• Non payment, if you are on a paid plan in future.
• We reasonably suspect fraud or abuse of the service.
• Your use poses a security, legal or stability risk to the service or other users.
• We are required to act by law, a court or a regulator.

We will tell you what we have done and why, and give you notice first, where it is practicable to do so. In serious or urgent cases we may act immediately and tell you afterwards.

Contesting a suspension: email hello@chadgpt.plus and we will review the decision and reply. If we got it wrong, we will restore your account.

If we terminate your account for any reason other than your breach, and you have paid for an unused period in advance, we will refund that unused period on a pro rata basis.

You will have 30 days from the date we tell you your account is closing to ask us for a copy of your data before we delete it. Email hello@chadgpt.plus.

You can close your account at any time by emailing hello@chadgpt.plus. When you do, we delete your account, your profile record, your usage counters and your saved conversations within 30 days, apart from anything we must keep by law. You can also delete any individual conversation yourself from the history page.

We may update these terms. If a change is material, we will tell you by email or in the app and give you reasonable notice before it takes effect. Minor changes, such as fixing wording, take effect when posted.

If you do not accept a material change you can close your account. If you are on a paid plan in future, you can cancel without penalty and we will refund any unused prepaid period.

These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

If you are a consumer resident outside England and Wales, nothing here removes the protection of the mandatory laws of your country of residence, and you may bring proceedings in your local courts where the law of your country requires it.
